Terms and Conditions - My Mountain Cabin Rentals - North Georgia MountainsMY MOUNTAIN CABIN RENTALS, LLC PO BOX 388 BLUE RIDGE, GEORGIA 30513 706.374.4111 800.844.4939 fax 706.374.4120 www.1MyMountain.com RENTAL POLICY AND AGREEMENT This agreement constitutes a contract between the Guest(s) and My Mountain Cabin Rentals, LLC as (MMCR). My Mountain Cabin Rentals of North Georgia serves as the agent and representative of all owners of rental cabins in our rental program, and is acting at all times, in and for the best interests of the owners. OCCUPANCY - Guest(s) understands that My Mountain Cabin Rentals of North Georgia will only accept reservations from responsible adults above 25 years of age. ABSOLUTELY NO EXCEPTIONS. Guest who initiates rental will remain responsible for all guests(s) or Licensee of Guest(s) during occupany of subject property.
CLEANING FEES: Our cleaning fee rates will vary according to the size of the cabin. It is of the upmost importance to us that upon arrival you find your cabin in top-notch shape from the furniture, floors, bathrooms, bedding, dishes and linens to the hot tub. We assign each cabin with a specific cleaning crew who are very familiar where things belong or if any items are missing or broken. We do limit the number of cleanings our staff is assigned on any given day to ensure your arrival is met with a clean cabin.
CHECK-IN TIME is 3 PM at My Mountain Cabin Rentals of North Georgia, 3945 Old Loving Road, Morganton, GA 30560. EARLY CHECK-IN (9 AM) MAY BE AVAILABLE FOR A FEE OF $100 AND MUST BE PRE-ARRANGED. Keys are not available until the rental cabin is ready for occupancy. My Mountain Cabin Rentals will use all reasonable efforts to have the cabin ready for guest occupancy at check-in time, but My Mountain Cabin Rentals cannot guarantee the exact time of occupancy. Please call our office in advance if you are arriving after 5 PM so key arrangements can be made.
CHECK-OUT TIME is prior to 10 AM at My Mountain Cabin Rental's office. LATE CHECK-OUT (4 PM) MAY BE AVAILABLE FOR A FEE OF $100 AND MUST BE PRE-ARRANGED. Please be prompt as to allow us to have adequate time to prepare the cabin for the next guests and return all keys to My Mountain Cabin Rentals office before leaving to avoid additional charges. RESERVATION REQUIREMENTS - 25% of the total rental fee in at the time ot booking in order to confirm your reservation. A signed RESERVATION AGREEMENT is required to secure a reservation. If booking on-line, you will need to accept these terms & conditions when prompted to do so. My Mountain Cabin Rentals accepts MasterCard, Visa, and Discover, Checks drawn on U.S. Banks. (If securing with a check, it must be received by My Mountain Cabin Rentals within 3 days after booking has been made or the reservation will be cancelled). My Mountain Cabin Rentals will not accept checks on reservations made less than 30 prior to arrival. Balance of rental fee is due the day of arrival with cash, certified funds, traveler's checks, MasterCard, Discover or Visa. Please reference reservation number, dates and cabin name when sending check or money order. WE DO NOT ACCEPT CHECKS (EXCEPT TRAVELER'S) AT CHECK-IN. CANCELLATION - ALL CANCELLATIONS MUST BE MADE IN WRITING - E-Mail www.1MyMountain.com (you must receive an acknowledgement from us receiving your email) or Certified Mail. A $30 administration fee is assessed for any cancellations or cabin/date changes. However, if Guest(s) cancel less than Thirty (30) days prior to their arrival date, there will be no refund. My Mountain Cabin Rentals of North Georgia will modify your reservation to be used within one year from the original arrival date and use the remaining deposit towards that stay. For a refund deposit, cancellations must be in writing and sent by certified mail 30 days or more prior to arrival date (less a $30 administration fee) to: My Mountain Cabin Rentals 3945 Old Loving Road Morganton, GA 30560 NO-SHOW POLICY - The total amount of the reservation will be charged the day of arrival along with a $30 administration fee. RETURNED CHECKS - A $35 service charge will be incurred for any returned checks. CONFIRMATION - Confirmation of the reservation will be emailed to Guest(s) immediately upon booking your reservation on-line. Please read the confirmation for accuracy of dates, mailing address, number of adults and/or children and accommodations. Report any errors to My Mountain Cabin Rentals as soon as possible. Pay close attention to the number of persons on the confirmation. Occupancy is limited to REGISTERED GUESTS ONLY. Absolutely no overnight visitors are allowed without prior arrangements made in advance in writing to My Mountain Cabin Rentals of North Georgia. ADDITIONAL GUESTS (More than the reservation agreement states) - Additional guests, (our rates are based on 4 adults) over the age of 12, must be pre-approved by My Mountain Cabin Rentals and there will be a charge of $10 per person per night. There is no charge for children under the age of 12. KEYS - All keys must be returned to the My Mountain Cabin Rental office upon Check-out. Our rental cabins are privately owned and Guests are responsible for lost keys. The property must be re-keyed in the event the keys are lost, misplaced or not returned and you will be responsible for the cost of this procedure. SATELLITE TELEVISION - All cabins are privately owned and have different subscription packages for satellite. My Mountain Cabin Rentals does not guarantee any programs or events. TELEPHONE CALLS - All cabins are equipped with a telephone. All local calls are free. All long distant calls are to be placed by credit card, 800 or calling card. FIRE PLACES - All My Mountain Cabin Rental cabins have wood burning or gas log fireplaces. WOOD BURNING fireplaces are seasonal and My Mountain Cabin Rentals will provide wood, free of charge, for interior fireplaces, from October 1 through May 1st. Firewood is not provided for fire pits but local gas stations and grocery stores sell small bundles of wood. Please note, if you use an out door fire pit, you are responsible if any "wild fires" start and could be subject to fines or response charges by the Department of Forestry. If you are not proficient at starting fires, refer to FIREWOOD in our FAQ's. No fire will be left unattended and no other item (charcoal, accelerants, etc.) will be burned in wood log fireplaces. Guests agree to pay a clean out fee of $50 if any items other an wood logs are burned in fireplace. Please be considerate when burning the wood. GAS LOG fireplaces - no other items (hot dogs, marshmallows, wood, etc.) besides gas logs will be burned in gas log fireplaces. Guests will not disturb, adjust, move, cook-over or otherwise damage gas logs in fireplace box. Guests failing to comply will result in a $250 damage fee charge. BARBECUE GRILLS - Charcoal is NOT provided for rental cabins with charcoal grills. Propane IS provided for gas grills. Each rental cabin has a grill, please refer to the cabin description of the cabin you are interested in. NO SMOKING - All cabins are NON-SMOKING and this policy is strictly enforced. Smoking is allowed outside on the porches and decks. Please do not dispose of the cigarette butts in the yard or surrounding grounds. If cigarette butts are found on the grounds, an additional cleaning charge will be incurred. ALCOHOLIC BEVERAGE - By Georgia Law, no drinking of alcoholic beverages by persons under the legal age of 21 is allowed. NO HOUSE PARTIES ALLOWED. Violation will be cause for immediate eviction with loss of all rent monies paid. PETS FRIENDLY CABINS- Most cabins allow pets so please contact us prior to reserving a cabin if you would like to bring your pet with you. The flat-rate pet fee charge is $25 (up to 2 pets). Pets are to be housed in a crate inside of cabin when Guests are away from cabin. Guests are completely responsible and liable for any damage, caused by their pet(s), to the cabin and its premises during their stay. If you have a pet and it is not listed on the reservation agreement, your immediate eviction and loss of all rents and security deposit will result. Prior permission must be granted. Pets are not allowed on furniture or bedding. CABIN FURNISHINGS & EQUIPMENT - All cabins are privately owned with furnishings and equipment provided by the cabin owner. My Mountain Cabin Rentals of North Georgia cannot make any changes to this. Moving of furniture is prohibited. If you require special appliances or equipment, please bring them with you. Decor, style, color and themes will vary between rental cabins. Furnishings are subject to change without notice. - All furnishings/furniture in the cabin are in place as the owners wish them and Guest(s) agrees to pay not less than $100 if furniture is rearranged in such a manner that results in cleaning services being delayed. DEER - COYOTE - BEAR - INSECTS - Deer, Coyote, Bear, Turkey, Possum, Raccoons, Ladybugs, Carpenter Bees, Wasps, Scorpions, Ticks, Ants, Chiggers, etc. may be encountered in the mountains. There is no refund for the presence of typical North Georgia mountain creatures. LINENS - All cabins are supplied with bed linens, towels, blankets and pillows. These items are not changed during your stay. My Mountain Cabin Rentals provides your initial supply (1 to 2 days) of paper products, hot tub chemical shock, soaps, detergents and trash bags etc. for your convenience. CABIN DESCRIPTIONS AND RATES - Information regarding the individual rental cabin is believed to be accurate but cannot be guaranteed. We have made every effort to ensure that all the information on the My Mountain Cabin Rental website www.1MyMountain.com is current and accurate. The possibility of errors and omissions still exists. We will be happy to confirm all the information or answer any of your questions prior to booking your reservation by calling us toll-free at 800-844-4939. Rates, furnishings, fees and taxes are subject to change without notice. Rates for weekly stays are found on our website at www.1MyMountain.com. These rates are based on 4 persons. Rates do not include end-of-stay cleaning fee, pet fees, extra person fees, damage protection fee or rental tax. Most of our properties can be rented for a two-night minimum stay. Minimum night requirements: Two night minimum for non-holiday, Three night minimum for holiday weekends, Four & Five night minimum for peak summer and autumn leaf seasons as well as Thanksgiving, Christmas, New Year's, Easter and Independance Day. Guest(s) should shower before and after each hot tub use. It is also highly recommended that swim suits be washed with clean water after each use. This is for personal hygiene and sanitation purposes. Following these instructions limits the likelihood of bacteria build-up between uses. Drinking containers i.e. glasses, bottles, cans; smoking, and pets are strictly prohibited. If evidence is discovered, a fine of $100.00 will automatically be charged to responsible Guest(s) of record. All hot tubs go through (2 to 4) automatic filtering/cleaning cycles that last up to (3) hours. Hot tub and Jets will not turn off during this cycle. TRASH AND/OR LITTER - All trash must be bagged and placed in trash cans or trash bin provided on property. Failure to bag trash or placing loose trash in trash cans/bin will cause an additional Housekeeping fee/fine of $50 automatically charged to the responsibile Guest(s) credit card of record. Should the trash cans be full upon arrival, please contact MMCR. LITTER: If litter (trash reminisce, cigarette butts, cans / bottles, etc...) are discovered post occupancy an additional Housekeeping fee of $50 will be assessed and charged to the guest credit card of record.
LOST & FOUND - Any personal items left in the rental cabin can be mailed to you at your request for a fee of $20.00 plus postage. We will charge your credit card and an invoice will be included in your package. Any items left over 7 days will be donated to charity. HOLD HARMLESS & INDEMNIFICATION - Guest(s) agree to hold harmless & indemnify the Owner & MMCR for any liabilities, damage, theft, expense or cost arising from or related to any litigation or claim which may arise out of or in connection with Guest(s) occupancy & use of the rental property. This is including but not limited to any liability or claim for personal injury or theft or damage of personal property that is made, incurred or sustained by Guest(s). The terms MMCR" & "Owner" are used in this agreement shall include their successors, assigns, heirs, employees, agents and representatives where the context requires or permits. The terms "Guest(s)" and Licensee of Guest(s), successors, assigns, heirs, guests, invitees, representatives and other persons who happen to be on the rental property during Guest(s) occupancy (without regard to whether such persons have authority under this agreement to be at the rental property), where the context permits or requires. DAMAGE PROTECTION FEE (DPF) – Each reservation is charged a non refundable fee of $30.00 to purchase a Damage Protection Waiver. This waiver is designed to protect the guest(s) and owner(s) from excessive charges due to accidental damage. The DPF provides up to $500.00 coverage to repair accidental damages (beyond normal wear and tear). If damages surpass $500.00, additional charges will be applied to the credit card on file and written documentation will be sent to the Guest(s) of record. If damages are determined to be caused by the willful misconduct, misuse, or pets; the Damage Protection Waiver can be voided by Agent on the grounds of intentional act(s), gross negligence, willful and wanton conduct by Guest(s) or Licensee of Guest(s). These occurrences will result in the Guest(s) credit card on file being charged in full for any damages and management fees. This waiver does not cover additional fees or fines. ALL ACCIDENTAL DAMAGE MUST BE REPORTED TO THE MY MOUNTAIN CABIN RENTAL OFFICE BEFORE GUEST DEPARTURE TO QUALIFY FOR PROTECTION. DENYING PAYMENT, ADDITIOAL FINES OR FEES - Should MMCR have to obtain legal advice or counsel for any matter arising from any payment discrepancy involving a Guest(s) or payment vendor such as a credit card company, MMCR's legal counsel Blue Ridge Law, PA (931 E. Main Street, Suite A, Blue Ridge, GA 30513 (706)632-1900) will seek rightful collection or payment for MMCR on behalf of Owner. If disputes are transferred from MMCR's management to a collection agency, responsible Guest(s) of record will be liable for all incurred charges proved to be their responsibility in a court of law. DISPUTES - This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia, and shall be treated as though it were executed in Fannin County, Georgia. Any action whatsoever in relation to this Agreement shall be instituted and prosecuted only in the Fannin County Superior Court, Georgia. Guest(s) specifically consents to such jurisdication & to extraterritorial service of process.
